Individual License Agreement (Basic Single-Use) 

 

This Individual License Agreement (this ”Agreement” or ”Basic License”) is a legal agreement between you (”Licensee”) and scenicfootage.com (”Licensor”) regarding your use of the stock footage (”Footage”) downloaded from the Scenic Footage website under this Basic License. 

 

By downloading or using any Footage from Scenic Footage, you agree to be bound by the terms and conditions of this Agreement. 

 
1. Grant of License 

Subject to the terms and conditions of this Agreement, Licensor grants Licensee a non exclusive, non-transferable, non-sublicensable, perpetual, worldwide right to use, modify, and incorporate the Footage into one single project or end-product (”Project”). 

This license is for one individual natural person. You may not share, sell, or otherwise transfer your license or the Footage to any other person or entity, except as expressly permitted herein. 

This Basic License permits the use of the Footage in one (1) Project only. If you wish to use the Footage in a different or separate project, you must purchase a new license for that Project. 

 

Social Media & Content ID: This license does not grant the right to register the Footage (or any Project containing the Footage) with any digital fingerprinting or Content ID system (e.g., YouTube Content ID, Facebook Rights Manager).

 
2. Permitted Uses 

You MAY use the Footage for one (1) Project in the following categories: 

  • Web and Digital: A single website, blog post, social media campaign, or online adver tisement. 
  • Promotional Video: A single corporate video, training video, or promotional video for web or internal use. 
  • Marketing and Advertising: A single digital marketing campaign or presentation.
  • Personal Project: A single, non-commercial video project. 
  • Client Work: You may use the Footage as part of one final Project delivered to a client. The client may not extract the Footage for any other use, and this license does not transfer to the client. 
 
3. Restricted Uses 

You MAY NOT do any of the following: 

  • Broadcast, Film, or Television: You may not use the Footage in any feature film, documentary intended for theatrical release, or in any broadcast, cable, or satellite television program or series under this Basic License. Use in such productions requires the purchase of a separate Extended License from Scenic Footage. 
  • Multiple Projects: You may not use the Footage in more than one (1) Project. A new license is required for each new Project. 
  • Resale or Distribution: You may not sell, license, sublicense, or otherwise distribute the Footage as standalone stock footage, or as part of a stock footage library, collection, or archive, either for a fee or for free. 
  • Use in Templates: You may not make the Footage available as part of a digital template (e.g., website template, video template) where the primary value of the template is the Footage itself. 
  • On-Demand Products: You may not use the Footage in connection with ”on-demand” products (e.g., t-shirts, mugs, posters) where the Footage is the primary element of the product. 
  • Defamatory or Unlawful Use: You may not use the Footage in any way that is pornographic, obscene, defamatory, libelous, or in any manner that promotes hatred, discrim ination, or violence. 
  • Sensitive Use: Footage depicting identifiable persons may not be used in connection with sensitive topics (e.g., mental health, criminal activity, or political advocacy) without a disclaimer stating the person is a model used for illustrative purposes.
  • False Representation: You may not use the Footage in a way that implies you are the original creator of the Footage. 
  • Trademark Use: You may not use the Footage as part of a trademark, service mark, or logo. 
  • AI and Machine Learning: You may not use, or allow any third party to use, the Footage for the purpose of machine learning or artificial intelligence training, including but not limited to generative video or text-to-video models.
 
4. Intellectual Property and Ownership 

You acknowledge and agree that all rights, title, and interest in and to the Footage, including all copyrights and other intellectual property rights, remain the sole and exclu sive property of the original creator (”Contributor”) who supplied the Footage to Scenic Footage. The Contributor retains full ownership of the Footage. 

 

Licensor represents that it has the full right and authority to grant the license con tained in this Agreement on behalf of the Contributor. 

No ownership, copyright, or title in the Footage is transferred to you by this Agreement. The only right granted to you is the limited license to use the Footage as specified in this Agreement. 

 
5. Model and Property Releases 

When Footage contains depictions of identifiable people and/or property, Scenic Footage will clearly mark whether the people and/or property depicted are the subjects of release agreements that enable you to use such Footage without further clearance (e.g., either “Model Released” or “Property Released”).

 

If Footage depicting identifiable people and/or property is not marked as “Model Re leased” or “Property Released” (as applicable), you may still use such Footage at your own discretion. However, you are solely responsible for obtaining any additional releases (such as for privacy, publicity, or other rights) that may be required for your specific use of the Footage. Your use of such non-released Footage is entirely at your own risk. 

 
6. Termination 

This Agreement is effective until terminated. You may terminate this Agreement at any time by destroying the Footage and any copies thereof. 

Licensor may terminate this Agreement at any time if you breach any of the terms. Upon termination, you must immediately: 

  • Cease all use of the Footage. 
  • Destroy or delete all copies of the Footage from all your systems and storage (digital or physical). 
 
7. Warranty and Limitation of Liability 

The Footage is provided ”AS IS” without any warranty, express or implied. In no event shall scenicfootage.com or its suppliers be liable for any direct, indirect, or incidental damages (including loss of profits or business interruption) arising out of the use of the Footage.

 
8. General Provisions 
  • Governing Law: This Agreement shall be governed by the laws of the USA.
  • Entire Agreement: This Agreement constitutes the entire agreement between you and scenicfootage.com regarding the subject matter hereof and supersedes all prior or contemporaneous understandings. 
  • Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 
  • Unauthorized Use: Any use of the Footage not expressly authorized by this Agreement constitutes copyright infringement.

By downloading and using our Footage, you acknowledge that you have read, understood, and agree to be bound by these terms.
